TERMS & CONDITIONS
Congratulations on your selection of a healthy, happy puppy from On The Bluff Labradors. Great care was taken in the selection of this breeding. With proper love, care, feeding, and training, your puppy will greatly return your devotion.
Seller Representations:
- The puppy will carry the prefix On The Bluff in its registered name.
- The guarantees of this contract apply only while the ownership of the dog remains with the original purchaser. Violations of this contract shall result in the return of the dog and its Registration Papers
- Seller guarantees the puppy is in good health, has had 2 Parvo vaccinations, (1 at 5 weeks and 1 at 7 weeks of age), has been wormed 4 times with pyrantel pamoate and Safeguard and has seen a vet before the buyer takes possession of the puppy.
- The Buyer has 2 Weeks to take the puppy to the veterinarian for an examination. The buyer agrees not to vaccinate the puppy at this visit. If the puppy is found to be in poor health, and it is established that the poor health is due to a genetic condition not to a change of diet or any other reason such as a virus, ingestion of some foreign object, etc, buyer has the option of returning the puppy to the Seller at Buyer’s cost for a full refund
- The Seller Health Warranty is for one year from the date of purchase and does not include viral illnesses, cancer, improper bites, hernias, hypoglycemia, Guardia, Salmonella or Coccidiosis. It also does not include any illness due to the ingestion of foreign objects, food, chemicals or physical injury.
- Puppy is guaranteed against genetic hip dysplasia for one year from purchase. Only hereditary hip dysplasia is guaranteed.
- Buyer agrees that if it is determined that the dysplastic hip condition is the result of abuse, neglect, poor nutrition, injury and/or accident-all guarantees will be null and void. H. All exams, x-rays, and fees shall be at buyer’s expense.
- The buyer will be responsible for and/all costs of the dog’s transport back to the seller for any circumstances pertaining to this contract.
- All eye exams must be done by a certified Ophthalmologist Veterinarian. Dog is guaranteed against Progressive Retinal Atrophy (PRA) eye disease ONLY. The guarantee is for 2 years providing the said dog has had eyes examined annually by a board certified Ophthalmologist Veterinarian.
- Guarantees apply only to replacements and NOT refunds. As long as there is a replacement available. Replacements will be made as quickly as possible.
- If the dog is bred BEFORE the age of 2 years of age ALL guarantees are Null and Void. No Exceptions!
- If this dog must be placed in a new home, the breeder has the first option to take dog back. The buyer must give the breeder this option by contacting them first.
Buyer (Owner) Obligations:
- This dog will be provided with humane, personal care, and veterinarian-supervised care. This dog will also be de-wormed. This dog will not be trained or used as an attack dog.
- If a puppy/dog is sold as a Pet/Companion, the Limited Registration will be checked on the AKC papers preventing any offspring from being registered. Breeding of the dog is prohibited.
- Buyer agrees to feed a RAW FOOD DIET as outlined in the puppy pick up packet and on our website. This can include cooked food but not pre-made dog food. Studies have shown that dogs raised solely on dog food are at risk for cardio myopathy and other conditions. If the puppy/dog is fed a diet that does not conform to the raw food diet as outlined – the warranty is null and void
- Buyer agrees not to start jogging, biking, agility, heavy or competitive field training or any strenuous activity that may damage the dog’s bone or muscle structure until it has reached a minimum of 18 months of age. (This is to allow the dog to reach a physical maturity level so that this kind of training does not damage the animal.) Buyer acknowledges that failure to meet these requirements will make all guarantees null and void.
- Buyer agrees NOT to spay/neuter their dog within the first 18 months of their life. There is substantial evidence now from numerous studies that spay/neutering a dog before they are grown puts the dog at risk for many conditions including, but not limited to: sarcoma’s, bone cancers and a wide range of joint dysplacia’s and disorders.
- We highly recommend a minimum amount of vaccinations and if you feel you must do them, separate them out and do one at a time. And only do one vaccination of each type. After that we recommend you titer your dog to measure his/her immunity. In this way you avoid unnecessary vaccinations which can cause serious side effects. Studies have shown dogs are fully vaccinated with only one vaccination which will last a lifetime. We do not recommend Distemper as it has become very rare and a recent study has shown it to put the dog at risk for Pana, a condition that causes the dog to grow too fast and become lame for a period of time. We do not recommend Boratello, (kennel cough) as it is not life threatening. It is just a cough. The dog is vaccinated for only 2 strains. There are hundreds of strains. We also do not like Lepto as it is a very hard vaccination and, like Boratello, only covers a few strains.
- Buyer agrees to take good and proper care of the puppy, feed and house the puppy properly, and control and contain the puppy properly on their premises to avoid loss by theft, running away, injury, or death.
- Buyer agrees Seller will REPOSSESS DOG UPON EVIDENCE OF NEGLECT AND/OR ABUSE at no expense to the seller within five (5) days of receipt of notice from the seller to the buyer, or face up to $1500 fine, or maximum award allowed in small claims court, from seller.
Legal Responsibilities:
- In the event of transfer of ownership of said dog from buyer, either intentionally or unintentionally, with or without consideration, seller’s said obligations shall end.
- Buyer agrees to indemnify seller for any legal action arising from the actions of said dog.
- When you sign this contract, you acknowledge you have read, understood, and agreed to its terms and conditions. The written terms of this contract constitute the entire agreement. Buyer understands that if buyer violates this contract, that buyer is responsible for all legal costs (including but not limited to reasonable attorneys fees) the seller shall accrue enforcing this contract. That this contract is under the jurisdiction of the State of New York, in the county of Columbia. It is agreed the place of venue shall be in Columbia County, New York.
